
Jury trials can be very stressful often having tremendous consequences. But after the best efforts in attempting to resolve a case, if the only option left is a jury trial, we will be prepared for that. My client, Lucon, was facing a felony domestic violence charge because his girlfriend broke her wrist during an argument. We argued successfully that my client was attempting to leave her apartment and while leaving, he accidentally bumped into her where she had fallen. The state had an x-ray of her broken wrist and a doctor testified at trial that the x-ray did show a fracture. Both my client and his ex-girlfriend testified. The state had an excellent district attorney who was the head of the Domestic Violence unit. However, during closing arguments, this experienced DA was so certain of a conviction that he conveyed arrogance and cockiness. Throughout the trial, I was patient with the jury. I explained that when my client had gathered all of his belongings, he was not trying to push her down, he just wanted to leave. Any contact was purely accidental. After careful consideration, the Jury returned a not guilty verdict.
